DMCA Policy

Crimson Desert Embargo Lift respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond promptly to claims of copyright infringement committed using the Crimson Desert Embargo Lift website or services if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website or services by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identify the copyrighted work: Provide sufficient detail to clearly identify the copyrighted work(s) you claim have been infringed. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
  2. Identify the infringing material: Provide reasonably sufficient information to permit Crimson Desert Embargo Lift to locate the material that you claim is infringing. This includes the specific URL(s) where the material is located on our site.
  3. Provide your contact information: Include your full legal name, mailing address, telephone number, and email address.
  4. Include both of the following statements in the body of the Notice:
    • "I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
    • "The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  5. Provide your electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid Notice of Alleged Infringement, Crimson Desert Embargo Lift will remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted the material that we have removed or disabled access to it.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with Crimson Desert Embargo Lift by providing our Designated Copyright Agent with the following information:

  • Identify the material: Identify the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
  • Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Provide your consent to jurisdiction: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, for any judicial district in which Crimson Desert Embargo Lift may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
  • Provide your contact information: Your name, address, telephone number, and email address.
  • Provide your electronic or physical signature: A physical or electronic signature of the subscriber.

If a counter-notification is received by Crimson Desert Embargo Lift, we may send a copy of the counter-notification to the original complaining party informing that person that Crimson Desert Embargo Lift may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.
